Both parties fall under habitually resident (we were born in Europe, but have lived in UK for 10 years and were married in UK). My question is as well as the box 'The Petitioner and Respondent are both habitually resident in England and Wales' do I also tick the first box 'Article 3(1) of the council Regulation...'

Yes tick the council regulation box (the first one) then habitually resident.
