Hi there I have just got my Petition back from court and it says part 4 of petition is wrong, and it also says the parties still reside at the FMH how long is this anticipated to continue? I rang the court and the girl said I should get an extra affidavit form to write the letter on explaining my situation, what does this mean? Cant I just write the letter on normal paper and resubmit to court? Also do I have to write the amendments on the affidavit in red ink? thanks in advance

If you amend Petition then you underline the amendments in red ink, you never write in red ink.Do as the lady says and explain the situation on an affidavit, this is then sworn as true and will be accepted by the judge, ill try and find a blank one so you know what your looking for, hang fire.

I think I understand, but on the affidavit there is not enough room for my letter explaining why we are still living at the same address, so is it ok to just print it onto a blank sheet and attach it to the affidavit?

You can do it in one of two ways,

Copy and paste the first part of the affidavit then write your letter and add the last bit of the affidavit.

or

Write see attached document (your initials) so if john brown "JB1".

Does that make sense?.

Have taken the amended Petition and the letter with affidavit to the court today. Got it sworn in - felt like swearing too when she said that will take a month as the court is so behind on its work! So wish me luck guys that the judge grants our Decree Nisi, surely when 2 people both want a divorce it cant be so difficult?!
