Hi all,

I have just been awarded my Nisi which i am thrilled about! He has also been ordered to pay the costs!

My question is, how does this actually happen, how do i get the money from him?

Does the court send him a form or something and he then send me the money or...!!??

The court were not helpful when i asked about this....

Many thanks,

N

Hi
I am in the same situation and my sol has sent his sol a bill for the amount that it has cost to get to the Decree Nisi stage. My sol tells me that this will be paid on completion of Absolute.
Unsure what happens if he refuses to pay or disputes the amount of money requested so any advice greatly appreciated??

1. The costs become payable on the making of Decree Absolute, not before.
2. If the amount is not agreed, your solicitor prepares a bill in a specified form and serves it on the other party with what is called a notice of commencement of assessment.
3. If the other side file no objections, your solicitor obtains a default costs certificate from the court. This specifies the amount to be paid. You now have a money judgment which can be enforced the same way as a debt.
4. If there are objections to the bill, either you thrash out a deal or the court will list a hearing for the judge to decide on the amount. Once the judge has decided, that also is a money judgment and is enforceable.

Thank you. I don't have a solicitor I did it all myself, how does it work in this case?
