My partner separated from his wife 12 years ago and she moved away from the area and bought a new house. He subsequently was made bankrupt and the matrimonal home went along with this. The two children are now 19 and 17 (out of full-time education). My partner has a pension. She has a business of her own. My partner is likely to come into an inheritance in the next six months or so. Is there anything that she is entitled to as we would like to go ahead with diy divorce without getting into a messy solicitor situation!! :(

How long have they been married in total? Since its at least 12 years it must be quite a long marriage so the starting point would be 50/50 of what they have now.

19 years is a long marriage. They may have been seperated but as they were still married both still have a claim on the others aseets for that time too.

Sounds though like she has built up assets of her own since the split.

Although you might be able to ring fence the inheritance if there are enough other assets it may be worth going ahead before any likely inheritance occurs. You never know it might not happen.
