I have my FDH in just over a month and I still do not have adequate answers to many questions about my stbx's finances and expenditure (missing savings, large unexplained expendure etc). Without this information I am not in a position to know what to offer or accept.

At the first appointment the judge asked him to provide an explanation as to where all the money went. His response did not explain where it went, so I tried to contact him to request more information and ask some further questions myself. He will not respond.

Should I be submitting something to the court before this appointment pointing out what information I require and why?

Hi Tasha,

You say that your xtb was asked by the judged. Was this in the form of a court order - ie 'directions' from the court?

If you do not understand his (or your own) financial position you cannot make an offer to settle - how can you?

You might consider listing all the things you know he needs to answer and send it to him. If he doesn't answer or answers inadequately by the time of the hearing then ask the judge to issue directions that he does answer and ask for costs (as he is delaying proceedings and wasting the court's time - in the eyes of the court your time and your life unfortunately doesn't seem to count).

Best of luck,

YA
