I have received the applicants questionnaire from my ex's solicitor and they are trying to obtain details and financial details of my girlfriend.

I stay with my girlfriend frequently but do not pay any of her bills and still maintain my own occommodation of which I pay the bills there.

I do not belive this constitutes as cohabiting and I am not willing to supply details as she has not been any part of the divorce.

Cohabitation will have an effect on a settlement as your needs will be less.

However, if you are not cohabiting there is no need to provide the information the other side seeks as this will create difficulty.

The reply to the question should be that the information sought is irrelevant as there is no cohabitation and no plans for cohabitation (subject to the latter being the case).

You can refer to the individual entries on your bank statement to illustrate (if asked) that you do not contribute to your partner's accommodation or consumables.

If the other side wishes to pursue the issue of cohabitation this can be dealt with on cross examination at a later stage (final hearing).
