A question for my neighbour if that is ok as her partner will not let her use the computer as he says it is his.

He has decided that he wants to seperate but will not do anything about it. She is staying in her bedromm all the time but he is constantly harrassing her. She has notified police who say they cannot do anything as he has not hit her, he has in the past.

Anyway she would like to leave but her solicitor says she would still have to pay half the mortgage until the property sells. Is this correct as from other threads I have read the advice is this is not the case as he is living in her half of the house rent free.

They are not married but the house is in joint names.

Thanks for any advice.

Your neighbour is in an abusive relationship - and she probably isnt even aware that what he is doing is abuse :(

I would suggest that she contacts the local Woman's Aid centre www.womensaid.org.uk/ They have a free 24hr helpline - 0808 2000 247

I believe she could seek a non-molestation order to prevent him from continuing this abuse, and there is also another order that could remove him from the house - but I cant rememberer the proper name for it, sorry.

The rent you are referring to is known as occupational rent, and yes, she could seek this from him if she moves out (but to where?).

Others who have proper knowledge of this will respond - but my advice would be for our friend to contact Women's Aid immediately.

The police were there last night but he is saying it is her who is causing the trouble and they said unless he hit her they could do nothing.

She looks terrible and he has taken lots from the house to his mothers including her jewellery but the police are not interested.

I will pass on the number to her.

She could move out and stop paying the mortgage, the mortgage company will chase her for payments if her husband doesn't pay, if she explains the situation and tells them she would be happy for them to repossess they may focus on getting payments from her husband but will still hold her jointly liable. Stopping paying half the mortgage won't reduce her interest in the house.

The other order Ruby was thinking of is an occupation order.
