x2b moved out last year. I am on JSA. We have been in court over two yrs for son 12 custody. He managed to turn son against me so much that son 12 was making serious allegations against me and called police 4 times. Son now temporarily with ex until some reports on 17 Feb for Directions hearing. What is concerning is that ex has stopped paying mortgage and I have no where to go and no money. 16 yr old daughter lives with me
ex has managed to hide all his assests I know he was share holder in his fathers business but completley denies. He has not disclosed all his accounts and goes away on luxury holiday while showing in court he is in debt.

I sent a copy of arrear letter to my solicitor .he did not reply.
Ex has got away with everything and I wonder who runs the law?

I applied for help with payments and I was granted £97.00 weekly. this is still £97 short monthly. checking my financial statement I will not be able to pay this amount. Is it worth making application for maintenance pending suite and going to court for that figure? can court grant more generously than just what is required since ex is a high earner now living at his parents house where he does not pay rent or anything else.

It's impossible to say based on the information given. Maintenance is awarded according to your need and the ability of your husband to pay. When there is no evidence of hidden assets it may be difficult proving he has the ability to pay. You need to also consider the legal fees involved in a stand alone MPS application which are in the region of £2-3k. YOur solicitor who knows the details is in the best position to advise.
