Our formal family home has been sold and we have both signed the Consent Order. At the moment the equity in the house is being held by the solicitor dealing with the house sale. Does the consent order have to go to court before the money is released to me or can my ex say it can be released to me as we have agreed on the consent order terms?

First question is, are you sure there is a consent order ?

Sounds stupid but you will be surprised how many people think there''s a consent order when there isn''t - it''s mere a draft awaiting consideration. You had better make sure that the order has actually been sealed.

But assuming it has been, then the order itself will lay down what has to be done and within what time limits.
