Hi,

Just after some advice. Me and my wife seperated 5 years ago and she has claimed benefits all this time at her mums to prove we been seperated this long and she has not lived with me this time.

We are now going to get divorced and she wants half my house. She has never contributed anything to the mortgage and no bills in her name. All the time I been alone her I have spent a lot of money doing work on the house.

Is she still entitled to half of equity?

Also how about other assets like second investment homes I bought since we seperated. Is she entitled to half them?

I think she is trying to claim she has lived at house all along which is only going to get her into trouble with benefits she claimed, do you know what the consequences of this could lead to?

How long were you married and do you have children and if you do what ages are them. Why is your wife claiming benefit? Is she able to work or unable to due to childcare etc

Sulkypants is absolutely right. Without this information you can''t even start.

Benefits are an important part of some divorce settlements. Anyone who knowingly makes false statements to obtain a benefit to which (s)he is not entitled is committing a criminal offence, but that is a separate issue. If your wife is getting benefits that suggests a low income.
