Hi my stbx went bankrupt without telling me- I only found out when all our accounts were stopped!
My stbx had a 18k business loan with a personal guarantee, after pressure from the bank I was forced into agreeing to pay it or they would come after my house. I have nearly paid this off with no help whatsoever from my stbx ( we seperated soon after the bankruptsy plus he went to prison for an attempt on my life). Will the courts take into account the loan payments I have made when making a financial settlement, I personally see this as him having severely effecting the family pot or have I been stitched up again by the stbx again? thanks for any advice x

Well, you''ve certainly been stitched up.

The problem you have, of course, is that a bankruptcy order will vest most of his assets in the trustee.

You say '' my house ''. Your own personal property does not vest in the trustee. Can you clarify whose name the house is in ?

If he is bankrupt his means will be very limited. Unfortunately you can''t get blood out of a stone.

Thank you Charles for your reply,Sorry my post does look I am talking in the present time, My stbx was made bankrupt while we were still married which I knew nothing about ( In 2006). My question is mainly asking about the fact that he hid the fact of being bankrupt until it was too late and his business loan I have paid and still paying, would the courts take this behaviour into consideration and take into account the loan I have paid when considering the financial resolution?
