Hi got divorced a year an a half ago and last month, I finanlly got my ex husband to sign a Consent Order to pass the house ober to me, This has all been approved and agreed through the courts. Now I am looking at remortgaging and to add my new partner to the property and I have been advised that my ex needs to sign another form to transfer the title deeds is this correct? I thought the consent order had finanlised this?

The consent order specifies the steps that have to be taken.

But he would still have to sign a document transferring his share.

I don't think he'd react very kindly to transferring his interest to your new partner

Without having seen the order I can't say for certain, but it looks as
though it will require him to transfer his share to you. What you do with it afterwards is your affair.

But you mention a mortgage. If there is a mortgage he will remain liable even though he is not allowed to live there. It is almost
invariable in cases like this that you will have to agree to pay the
mortgage, and to indemnify your husband if you don't pay and he gets sued.

If you re-mortgage, the old mortgage would be paid off and
all this would be unnecessary. But you need some legal help.
Don't worry, it's not rocket science and it shouldn't cost you
much.
