Hi, I am the respondent in a divorce and I need to delay the final order being granted as I need to protect myself until the financises are agreed and I am not on the deeds of our marital home even though it was bought during our marraige and I want to stay in the home until my son is 18 and my house rights will end if they are granted and he will be able to sell they home without me having any say. Pls can someone advise, much appreciated.

Yes he can sell the property but you can stop this from registering your matrimonial home rights which will prevent the property from being sold until a financial settlement or until Decree Absolute.

You can find the form at the Land Registry - there is no fee to register and you should not delay in submitting it. www.gov.uk/government/publications/notic...hts-registration-hr1

Thank you but I was aware of this I have home rights on place but that will end when the final order is granted in about 2 mths I need to know how I can stop the final order going through until we have agreed and signed something for the finances. Ive been told I can apply for a D11 interim order but I dont know if I should do it myself or pay a solicitor to do it to make sure its done properly so its not rejected and ends up being to late. Has anyone done this and been successful and what did you put as reasons etc

You can write a short statement and provide evidence in support of your D11 application to delay final order.
A delay will normally be approved if there are home rights in place and/or a substantial pension to consider. The judge would probably want to know what steps are being taken towards legally binding financial settlement.
It is perfectly possible to make the D11 application yourself. You should do it asap. First step would be asking him to agree to the delay so you can ask for a Consent Order rather than needing a hearing.

Hi Hadenoughnow, I dont think there is a chance that he will agree to this as h probably knows itll benefit him not to so does that mean that I will have to pay to have a solictor to do the hearing which will cost me more than i can afford or do i have to go and do you know if it will it be just me that has to attend if doing it myself or will he have to be there as at the moment I still cant see him without breaking down and i cant see that helping me in court either with the judge or in the ability to think straight. If I have to go alone without him there then I think I could manage. Hope Im not being overly expectant in regards to your help and advice.
