Hi, I and my wife have been married about 16 months and we are living in Scotland. We are separation and I been moved out from the house since 20 April 2009, we do not have any children yet. I wish to sign a Separation Agreement and do DIY divorce after a year of separation by ourselves to avoid the expensive solicitor fee.

However, we have settled the mortgage by us and me willing to let her to take over the mortgage and the house. I will remove my name from the house and mortgage as well.

But, the problem is I am afraid she would like to claim for maintenance from me. To be honest, she is a PHD and work as a research engineer, income £1820 per month. I only got the master degree and my income is £1980 per month. She got higher education than me and the monthly incomes between both of us are almost the same. Can she still able to claim any maintenance from me?

In addition, she got Rheumatoid Arthritis since last year and applying Chinese treatment at the moment instead of applies the medicine given by our GP. However, she is still able to work as full time. She work four days a week and still got the full pay of 30K per annum. In such case, can she still able to claim for maintenance from me?

Please advice.

Given that your wife is working full time, I cannot see why she would be granted maintenance.
