UK or OZ?

Hi, this is me...

I split with my husband 12 months ago shortly after emigrating from UK to Australia. I returned to UK and he stayed in Oz. Both agree we want amicable divorce, no kids or property involved.

My dilemma is whether to petition from UK or encourage him to petition from Oz. Family law in Oz seems more relaxed and suitable for us but I cant rely on him to organise it or delay procedure because he's so useless.

I'd like to have control as petitioner but as I'm in the UK it would mean waiting 2 years from seperation, and we both want the divorce asap. He will not admit adultery.

What input is required from him once he's started a petition against me? Can he stall things half way through? We will both use solicitors so I guess they should keep momentum going for me. I know i'm contradicting myself as we both want divorce sorted asap, but he's unreliable and unpredictable. I cant afford to attend court in Oz if it could ever come to that?

A petitioner does control the case, but of course if the other party is a pain you have to take steps to get around him being a pest.

With regard to which jurisdiation is better, you might want to have a chat with the guys at International Family Law Group, particularly David Hodson, who is qualified in both English and Australian family law.
