please help my daughter and her new husband wants to move back to england from scotland with her children from her first marriage,she told her ex a month ago that she want to move back,the before the move he took a court junction out to stop her moveing,she has custordy of the children,all he does is make there life a misery,doesnt work demands to see the kids when he wants,he has remarried and has one child and another on the way,can he hold my daughter in scotland for ever

I don't know about Scottish law, but would assume that the courts would decide what is in the best interests of the children. I guess they would weigh up the quality of life the children would have by moving compared with the probable loss of contact with their father.

How old are the children? Their views might be taken into consideration but as I say I don't know about Scottish law.

the chrildren are 12,10,7 but they dont want to stay with there dad when he has contact,my daughter say he can have them for 3 weeks during school holidays and half terms and they would meet half way to meet him,but he is saying no they would have to bring them all the way up and then collect them, he his still trying to rule her life
