Dear All,
First I want 2 say thanks to this website.
Can I take my children with me out of the country to live abroad outside EU.I'm not from UK, but my husband is. I want to dvorce and go back to my family and life along with my children. Would I be given custody of my children?


Any help/advice is greatly appreciated

Dont you think you are being unfair on your kids and there father.

The kids and the father should have contact.

The way the law is defined its highly unlikely that you would not get premission.

Contact is perfectly possible even if parents live in another country. To relocate the children from the UK you need either the consent of the Father or permission from the courts. Courts are not in the habit of preventing the free movement of adults but you need to present a well thought out plan demonstrating that arrangements for living, work, education, finances and contact with the children are both viable and practical.

It is a different scenario when both parents worked during the marriage and shared care equally. In these circumstances the court might consider it less disruptive for children to remain in the former matrimonial home with the Father, not to disrupt their education or ties to friends and family in the UK.
