I want a divorce, he doesn't ! What can I do?

Hi Everyone:

Basically I have been married for the last 3 years and 8 months, we have a 1 year old baby.

During all this time my parner have been denying our marriage to friends, relatives and people in general,I still don't understand the reasons, his family don't understand as well and they only say to me that he is a little bit strange. Additionally He is offending me verbally all the time he disagree with something, it is impossible to deal with him any aspect of the day by day. Besides this I just discover last week he put and Advert on Gumtree looking for a "No Strings Attached, Clean, Sexy and Fun" relationship during weekends and evenings.

He doesn't want to divorce and he is refusing to sign any kind of documents. I am not working at the moment but I am just waiting to sign a new contract to start work on the 14th September.

Which options do you think I have in this case that he refused to divorce?

Hi Shana,

Your husband cannot refuse to divorce. That's it in a nutshell.
If you start divorce proceedings, he will have to 'engage in proceedings' as it is called.
He may not wish to do so, he may drag his heels, kick and scream, but he will have no choice.

You say he is refusing to sign any kind of documents - if by that you mean a divorce petition, he will have to in the end as the petition can be served on him by a bailiff.

Thank you for your answer. Yes, he refused to sign the divorce petition, but is good to know there is some laws to avoid someone to keep you by his side.
