how can i prove to the judge he ended the marriage therefor i feel i shudnt have to pay for the divorce? Do u think my solicior will have sent the papers in already? Is is to late to change my mind and get my money back?

If you both want the divorce then it seems daft not to agree to pay half the costs .. or you can suggest to him that you will agree to the divorce IF he pays all the costs. By cross petitioning and racking up costs you could end up with a much bigger bill - plus his costs as well. Speak to your soliciotr about withdrawing it ASAP.

Then see if you can also agree a Consent Order between you for the finances (wiki does one)and don't waste any more money on solicitors that you do not need.

Hi yea i said i would agree to the divorce if he dropped the costs but he wont have any of it. The way I see it, he ended the marriage, he applied for the Petition, he should pay for it. I know I would have paid for it had i ended the marriage. Ive contacted my solicitor but shes off today, I have spoke to her secetary who said they have already put the acknowlegment of service to the court stating that im putting a cross Petition in but secetary said i shud be able to withdraw it next week when my solicitor gets back, and going to do what u said, tick the box that says i agree but not to what he says. At least then itl be the judge telling me i have to pay half the costs.

Sounds like a good plan Gemma ... I know it is galling to end up paying anything at all when he was the one who started it ... but look on it as a great investment in your future ;) .

And don't forget to get the finances sorted - speak to your solicitor about a consent order so you can tie up all the loose ends.
