I left with my daughter the marital home last September (domestic violence). Managed to stay with a friend which gave me time to be able to arrange child maintenance payments and tax credits etc and was then able to find rented accommodation. I was/am on a low income so I didnt have much money and still dont but we are happy and safe now and I am able to put a roof over our heads and food on the table and provide for my daughter.

Now a year down the road feeling stronger and want to divorce. I have the papers myself to complete. There is no equity in the property and I have therefore had my name taken off the mortgage. By doing this it helped me to receive Housing Benefit.

The family car finance agreement is in my name! I cant afford the car but have managed the payments but need to get rid of it and buy something more economical. I am half way through paying the agreement, cant hand it back till June 2010 and that will affect my credit rating.

Can I apply for Ancillary Relief - a lump sum order even though there are no assets but I also left the home with all the furniture etc - at the time being free was more important but surely he should not be allowed to keep it all - can I not be compensated?

any advise woudl be sooooooooo greatly appreciated. thank you.
