hi all,my situation is this i bought my house
about 20 years ago on my own.about 8years ago
i put my partner on the deeds making her joint owner.we are on verge of splitting and
i am interested to know if i can be forced out of home. as i know she will be advised to
stay put as she has two children and would
not be able to afford a house on her own.
also if i was forced out when would i be able
to force a sale of the house as all my money
is tied up in the house?
we are not married and the children are hers
from another marriage.
any help would be much appreciated.

If you are unmarried contract law or complicated trust law in relation to property [Trusts of Land and Appointment of Trustees Act 1996] has to be relied upon. Who contributed what doesn't come into it, what matters is the parties' interests in the property. Where property is held in joint names, the law assumes that it is held equally, ie, 50:50, unless there is evidence of an agreement that the shares are in some different proportion.

It is quite a complicated and expensive area of law so it makes sense taking legal advice to find out where you stand and negotiating a settlement, avoiding the courts if at all possible.
