very stressed out

Well as the title says am stressed out HUGELY..

I am currently seperated with one child (19mnth), married only 9 months ago, found out 1 month in my oh was having an affair (had co habited for approx 18 mths b4 wedding), asked him to leave then decide to try RELATE he did not turn up.

Cutting long story short he told me the affair was nothing, he is still with her to this day. He has moved to Spain. He owns 50% of his company, he owns approx 6 rental properties one of which we cohabited in when our child was young, he also owns our house which we brought a year ago, all his money.

I gave up my job (earning 40k plus) to raise our child at his request and asmy job would not work part time or around a child.. I also own a property which is rented out ( a 1 bed flat) I cant move back there from a 5 bed house...

I have debt of 20k which he is aware of and agreed t pay off before i had our child as it is a big weight on my shoulders.

He is bullying me saying I am not entitled to any of the house and has oferred me a settement of : 2000 pcm maintenance, 1500 pcm for a morgage or rent and a lump sum of between 40 - 70 k deendingwhat mood he i in ( he is very verbally abusive).

He refuses to fill in form E , i have filed fora judicial separation as he told me he was moving to spain so our divorce would e deltwith under spanish law...

we are starting mediation ihave a sole appointment tom.

He has been very adhoc with contact with our child lied to me about where and with whom our chld is withand although not seen our child for more than a few hours in the last few months and now expects a 19 month old to fly to spain once a month...

I am at the end of the road here , my solicitors fees are mounting ( family are paying for me) my stbx refuses to deal with his sol at the mo, the other woman claims i am not married to him and that she is marrying hoim next year.. this was sent to me by her in a very long vindictive email as my sol puts it..

\i guess i just want some words of advise and to see if because it was such a short marraige ( this kills me as I married him wanting to spend the rest of my life with him) am i really screwed like he is saying to me as my sol cant help until he sends back form E or i file for ancillary releif which is so expensive..

The short marriage rule whereby both leave the marriage with what they brought goes out of the window when there is a child, the priority of court is the needs of children under the age of 18 mca s25(1)

You can begin the AR process by filing form A with court at a cost of £210 this makes the process more formal and will require him to give full financial disclosure only then can you begin to agree a fair settlement,

It is a very hard time and many lose hope but the court is there to attempt to gain a fair settlement for all but first and foremost the children or child in your case,

If you and him are domiciled in England the divorce will take place here and not in Spain also if he Marys before your divorce he commits bigamy a criminal offence,

I can't help with the financial problems I am afraid, but try to focus on maintaining a stable home for your child.

Ignore emails from your stbx's ow, they are irrelevant.

Concentrate on sorting out the finances as best you can. The court will want to ensure your child has a roof over his/her head.
