I have been married 28 years. I have 3 daughters, 27, 22, and 21 years old. I separated from my wife 6 years ago, due mainly to financial pressures and debts. In order to protect her from my business failings, instead of going into bankruptcy, I shouldered the debts myself allowed her to sell the marital home and keep the small equity to put down on a smaller home, which she could just about afford. I have paid since then £150 per week to her to help her with household bills, plus continued to support all my daughters as they went through university by paying the tuition fees, rent and giving them pocket money e.g my youngest receives £100 per week from me. I have just about kept my head above water. My personal debt is down to £120,000 but this all on unsecured borrowings, as I have no home, just renting.

I have met someone else, and want to marry her.

My questions are these. After 6 years of separation, can I force my wife to divorce? If not and she contests, what kind of financial demands can she place on me, bearing in mind I have no assets just debt, and I would naturally want to continue to help my daughters finish their education?

Yes after 5 years you can divorce without her say so. There is a form for it on the site somewhere. Have a look in the library. C
