Hi all - am new to this site today and am looking for some advice since I am sure my solicitor thinks I am just a complete control freak/nuisance!!!

My husband and I have been separated for 15 months and I instigated divorce proceedings 2 months ago but we still don't have an Acknowledgment of Service! I understand I can get bailliffs round and get them to sign an affidavit confirming delivery of the Petition but can the divorce proceed without him signing on the dotted line since it is less than 2 years???

Welcome to Wikivorce.

Unless you can show to the satisfaction of the court that he has been served with the papers, and swear an affadaavit to that effect, then I don't think so.

FOr example, if he had sent you an e-mail or text referring to the petition, you would have evidenced grounds to say to the court that he had seen them, but is playing silly b*gg*rs. Then the court may give leave to dispense with service.

Others may have a different viewpoint, but there are users here praying that their ex will respond to the petition.

Have never used a site like this before and it was a struggle to get a first post done!! LOL - will now have to search and find these 'others' of which you speak!

I have piles of texts and emails from stbx making reference to the petition since he is particularly unhappy with the grounds for divorce!! I s'pose there's piles of folks out there with the same prob too - hence being here!!
