good evening

I am considering separating from my marriage after 18 years. My problem is my husband refuses to leave the house adn refuses to sign a legal separation document. I have two children 11yrs and 13yrs.

What are my options?

If there is no real pressing reason for the separation in a way Peter is right - if your husband wont leave you might have to, to effect an immediate break. However it is the case that many longer standing relationships end for one party before the other is willing to accept that - you need to have grounds for a divorce if thats what you want but there are no legal grounds to force a separation document thats more something couples do when they both agree its over but recckon they will have to wait the two years of being apart to divorce. The best way to sort out wanting a separation is to talk at great length with your partner.

There are a lot of things that get us to a point where we believe that life with our spouse is no longer a life we want or deserve.

You talk of a Separation Agreement, is this because of religious sensitivity?

Why do you want to separate from your husband?
Has he been abusive?
Has he been unfaithful?
Have you fallen out of love with him?

It is important to understand some background and culture to give you a reasonable answer.

Perhaps if you give some more detail on why you wish to consider separation, someone will be able to give better advice.
