You should have the same 'rights' as your ex assuming that you have been equally involved in raising your children and not doing anything stupid like gambling, drinking, violence etc.
I agree with the others that it must be best to sort things out between you if at all possible.
I'm not a solicitor but I am told you start from the basis of equality and go from there.

I know somewhere you have posted the specifics of this, but I cannot find it at the moment :( and I did not just want to give you the glib answer that you are both equal in the eyes of the law etc etc etc, which isnt particularly helpful.
