Hi My Husband and I have been separated now for just over a year. We have a 7 year old daughter who I would like to move back to my homeland with once the divorce is through. She wants to move and is always bringng the topic up with me. She understands the fact that she willnot see her dad all the time but is happy to see him once a yer during holidays. I am unsure 1. On how to approach this with my soon to be EX, and 2. Can he stop this from taking place? I really don't know if at this stage to get a lawyer involved to start the process as we dn't have anything legally drawn up between us about the separation or regarding our 7 year old, it was all done using a online system and I believe that these arrangments do not always stand up.

I assume that your online divorce included no more than the simple Statement Of Arrangements for children.

And that you did not go to court to have a Contact or Residency Order made.

In which case the contact/residency situation is not finalised. So at the moment 'the system' is just assuming that things are OK as neither you nor your ex have taken things to court.

Of course it is best if you can reach an amicable agreement with your ex to return with your child to your homeland.

If he objects - you will end up having to go to court to get the courts permission to take the child abroad permanently. The court will typically approve such a move as long as it is convinced that it is in the best interests of the child and so long as your have shown a commitment to put in place acceptable contact arrangements for your ex.
