this is my first time on the site and was informed of it by a colleague at work.

my situation is as follows so any help / advice would be greatly appreciated.

I have been separated from my husband for 3 years (well sept 05 lived in same household but separately and finally left him and bought my own house in dec05 (with daughter) and we have lived here ever since. - so is it 3 or 2.5 at the mo???

The house is mine and my brothers and I have no wish to have anything to do with his property which he owns and I never paid any mortgage towards.

I initially filed for a divorce (had all the paperwork drawn up (paid quite a bit to a solicitor) for a general 2 year separation and he refused point blank to sign. Solicitor advised I could do unreasonable behaviour (have mobile bill to show 1000's run up) but this would cost more money so I stopped at this point. thinking waiting for 5 year would be better (even then he refuses to sign anything and wants to make life extremely hard)- do I have to or is there a quicker simpler route. I just want to get it over and done with and move on !!!!!

since we moved out he had refused to pay anything for daughter (except a few minor bits here and there but nothing regular) so I put the CSA on him after he refused divorce and now since apr08 I now get money (but boy did I get threats he would resign take full custody etc etc...)

Daughter lives with me and he used to see every weekend after split however since he has found out I am seeing someone it is every other weekend - although since this year he has seen her for less than one day a week if I add all the days up. Often refuses to get her things now saying he pays me money so I should get out of that. (She is 9 years old)

there will no doubt be lots more questions - however at this point I await any responses and advice from you.

Why not ring the number at the top of the homepage for a free 1/2 hr chat with a solicitor.
You can still class 3 yr separated cos you did not live together again for 6 mts or more.
As far as I know, if it is divorce based on 5 yr separation he does not have to agree to it for it to go ahead. Your childcare arrangements must be sorted.
Your financial and asset sharing can be dealt with separately to the divorce if your living arrangements are already sorted out & your daughter is housed adequately.
