Hi I've been separated for 3 years now and we are now looking to finalise it via a divorce. Currently the family house that my self and our 2 children still live in is in both of our names. I am unable financially to take over the mortgage myself but as part of the settlement my ex wants £40 000 out of the house.
Any ideas what I can do without having to sell the property and potentially having to move locality as would struggle to buy in the area I currently live on my own.

yOu need to post ore details about ages, incomes, assets and ages of children.

It might be possible to delay paying your ex their share in order to stay in the FMH with the children for the timebeing.

I have 2 children age 11 and 12. We were together for 20 yrs. My ex earns considerably more than I do. I work part-time. There is about £100 thousand equity in the house.
He currently pays the mortgage and gives me monthly maintenance. This was agreed in mediation. The house is the thing we can't agree on. He wants me to take a loan out against the house to pay him the 40 thousand. I don't object to him having this money but I'm reluctant to do this as would continue to tie me into a mortgage with him.
