Hello there, I am hoping someone can help me here. I have just printed off my D8 forms, ready to fill them in and my head has turned to mush lol. It is very straight forward divorce, we have been living apart and with new partners now for over six years. The children came with me, though now they are out in the big wild world on their own, being 22 years and 19 years (at uni) so they do not come into the picture, neither does any financial matters, we sorted all that way back when, sold the marital home and divided the funds. My partner and I decided we would like to get married thus the forms...my ex husband is aware, there are no worries of him not responding, we are all on good terms. Now to the forms lol
where it says the court has jurisdiction under Article 3 on the following grounds, do I just put Separation of more than five years?
I do not understand the part There are no children of the family now living except Do I put here that my children no longer live at home as they are now adults?
As for the other parts, do I just write...eg there are no proceedings etc.?
Annnnd also (sorry about this) where I need to fill in the part for the five year separation I have no clue what I should write? No one else is involved, no finances, no children, nothing, so how do I word that part.
With the prayer, I just sign it, I dont delete things even if they are not applicable do I?
Thank you very much to anyone who manages to read through all that and offer help.
Have you downloaded the guidance notes? You can get them in the resources section here or on the Court Service website.
In terms of juridiction, this is relating to habitual residence and domicile - the guidance notes will give you sample answers.
If the children are children of both of you they are children of the marriage, so you put there "over 18". If the children are the children of one of you they are children of the marriage, so you put there "over 18".
In terms of the particulars (the 5 yr separation) this is section 13 I think (sorry not got one in front of me).
