Hi All

im new to this site...

please can someone advise me.

I was married for approx 4 months and then separated and went through divorce proceedings after 12 months. there are no kids and no property involved. ill be unemplyed in a few weeks, ive already spent £10k on sols fees and have not even gone to court. we suggested a Clean Break which seemed the obvious thing to do, but we did not get a response she instructed a solicitor and then dropped the solicitor and then re-instructed her solicitor. now we are exchanging form E but we have not done this through using the Form A. is this the correct thing to do and also how much can she get. pls help thx

Hello

From the library

If a divorce petition is filed in a short, childless marriage (normally less than 5 years duration) it is unlikely that a 50/50 division of assets will be ordered particularly if one spouse brought substantially more assets to the marriage. Normally assets acquired prior to the marriage will be retained, or returned to the spouse who originally had them, and assets accumulated during the marriage will be divided on a 50/50 basis when the parties divorce.

Married for only four months you will both leave with what you brought surely the sols have told you this, why spend 10k on fees??

thx Dukey

in the 4 months there was not much gained in the assets at all. well what happend i petitioned for the divorce and then she inx her sols then decided to drop the sols and i still had sols, so i was continually chasing which ended up costing me. sols said what i came in with the marriage and what she came in with should be left as it is.
im considering self rep now as im not getting a response from her at all when we chase her sols they state they waiting for the ex to instruct. so im not sure what she is after.thx again dukey
