Hello
I'm fairly new here and wondered if I could get some advice.

Because my husband is verbally abusive - I intend to leave, doing a 'moonlight'.

We share a business which we both built up over the last 15 years. It is a legal partnership as well as the fact we are married.
I do all the admin side of it.
I will need to take the 'office' with me in order that we can both still get a living, at least until things are sorted out one way or another.
I can run the office side of it from wherever I am and I would be fair in this, split everything and give him monthly reports etc.
Talking this out before hand is not an option as my husband has not accepted the marriage is over and it's impossible to have a reasonable conversation with him.
I will tell him where I am afer a day or two.

My question is, am I within my legal rights to remove the office - computers/files/accounts etc to my new place of residence - which is still local to him?

I would appreciate your help if anyone knows.

Hi there

You need advice from a company lawyer, not divorce advice.

I suspect the answer is that you cannot remove company property without his consent, but I really wouldnt know for sure.

In essence, if I do not take the 'office' neither of us will get a living as he hasn't a clue about the admin side of the business - but I understand what you are inferring.

Has anyone else had experience of this?
