Hi,

Has anyone had the experience of having there ex "flee" with the children due to allegations of child abuse and then had those allegations formally investigated by the police and found to be "false and malicious".

Has happened to me. This delayed the children's hearing which is now scheduled next month.

Does this improve my case for residence?

Hi there

Doesnt quite work like that - you have to prove a link between her actions and harm to the children.

If the children are currently residing with her, you have a moutain to climb to persuade a judge to move them due to the status quo principle, which basicially is that there should be no change in children's circumstances unless there is evidence to suggest it would be in their best interests, and it is very very rare for a court to conclude an change of resident parent is in their best interests.
