hi have a question. i bought my flat after seperation wife had to remove her name from rent book as its ex council, has she any right to this flat we have 1 child who lives with her she at her mums many thanks

Your wife is living at her mother's, but doesn't have a home of her own (and nor does your child). So their housing needs have to be met.

If your wife has lived in the flat with you (I imagine she has as her name is on the rent book)then she has a right to live in the flat.

That's obviously not a practical option for you. But you now own the flat and your wife is entitled to a share of it to meet her own needs. So that might be a portion of the sale of the flat, or cash equivalent.

You may find that she would be awarded a higher proportion as she has to house your child and has no property of her own.
