Hi there..I'm new to this site and this whole ballgame! My husband and I are considering seperating amicably without solicitors if possible, we don't have kids or pensions or savings. I am the homeowner. If we seperate,I want to leave the country for a few months asap and he doesn't want to stay in the house on his own. Selling now would be crazy, we don't think there's much equity in the present time - he seems happy to walk away from the house and leave me to worry about continuing the mortgage/get a tenant in, accepting that if I sell further down the line any profit would be mine. His main concern is not getting saddled with any of my debt! Which I wouldn't allow to happen anyway. But this is his reason for wanting something formal or we could have just seperated informally. I may want to come back to the house in a few months or I may decide to put a tenant in and continue travelling/live abroad maybe for a year or two.

Has anybody got advice on legal seperations in this sort of situation???? I'm particularly keen to know how long it takes and best way to do without solicitors. And costs of course!

Thanks x

I don't see how you can have a legal separation without involving solicitors to at least draw it up!

If you google "legal separation" you'll see there are lots of sites giving information about it.

Hi

very simply - if you don't have a financial order endorsed by the courts, which you can only get at the time you divorce - you can each make a claim on the others assets at a later date.....

So if you keep the house and make £100k - half of it might be his :)
