Hi

I had to pay a contribution towards legal aid and now that the divorce has been finalised I have been asked to repay the rest of the legal bill. The calculation from LA Board is based on a house valuation from May 2007 when I was still actively married. The date of separation was 31/1/08, divorce was April 2010 and the date of transfer of title etc was in May 2010. Between May 2007 and May 2010 the market value of the house dropped by around £15-20K. Can I appeal the use of the out-of-date valuation, would I have to pay for a new valuation survey. This difference could bring down the amount I need to repay:unsure:

Are your costs so high that a reduced valuation would make a difference to the amount you pay? You usually only have to pay back up to the amount that you have recovered or preserved.

Do you know which Scottish legal aid scheme you are on? Is it the current one or the one which predates August 2009 (approx)?

Hi
Thanks for your reply, I applied for Legal Aid in Jan 2008 so I'm guessing I am on the old scheme?? Will this help or hinder me?

Hi Thanks for your reply, you are right, it won't bring my preservation down enough to reduce the amount of Legal Aid I will need to repay. As per my user name, always a Wishful Thinker
