Hello

I am currently unemployed, and on JSA.

My ex was living with me at my parents house. I have no savings and no other assets.

Also my ex has no assets, but I am unaware of whether she is using legal aid.

My sol (not any more) was adamant that I am only eligible for legal help, as there were no assets to claim from, and also told me that my ex was most likely not on legal aid, and if she was she should not be.

I don't particularly care as long I don't have to pay her anything, but at the last directions hearing, her sol mentioned something about future earnings.

I was not a big earner in my last job, 16K. If I have to pay her anything, I would rather stack shelves for minimum wage.

any comments would be appreciated, as I know I have not really asked a question.

Even if you get another job - similar to the last - it looks like you would not earn enough to be liable for spousal maintenance.

So that would just leave Child Support which will be due if you have kids and she is the main carer. This is worked out as a percentage of your net income.

15% for 1 child, 20% for 2, 25% for 3 or more.

hello again, - she obviously thinks I am hiding something, or more likely, to do with her immigration status, as she left 1 year.

I am 30, she is 28

1 daughter, lives with her, took her when she was 1 month old.

married abroad, took around 9 months for her to get spouse visa (2 year visa, and then apply for leave to remain, but she left me after only 1 year. I had advised home office that she left me.)

no assets, mortgage loan car or anything.
living with parents(their house) I was supporting her and my parents.

Final hearing is in december

yes, she is 3 now.

My ex only started the proceedings 1 year ago, after I divorced her abroad.

Hi there

With the age of the child and the fact you have an earning capacity, however limited, she is likely to walk away with a nominal order for spousal maintenance, but nothing else as there erm is nothing.

A nominal order is an order for £1 per year. However, what it means is that if she ever hits hard times and you are earning she can then make a claim against you for maintenance.
