Qualifying for Legal Aid

I didn't come anywhere near qualifying for legal aid. If I lose my job and have to go on benefits will I qualify or will I have to give up legal assistance.

Hi Kevin,
Depends on your net disposable income. If your NDI is more than what LAID set down as the amount you are allowed....there are alsi calculations for part contribution....I do not know the up to date figures in eng or scot.....but i believe the more info about your expenses you give...the more likely you are to receive legal aid assistance

The savings bit at face value does in any claim for legal aid at first look - if the house has any equity in iy you'd think you don't qualify, except that as this is what is in dispute during a divorce it doesn't count.

There seem to be rules about how big a house is allowable though

Not sure it helps - but in my case. My x is on income support and has been told he qulifies for funding even though his partner of over a year has an income and owns her house.

he probably does qualify as an income based benefit means you qualify as far as I can see. I think this is because an income based benefit has similar qualifying conditins so if you qualify for income support you also meet requirements for legal aid. If there is a partner with income involved you'd need to show it should be included in working out the benefits involved. I don't think they ever include the home in working out eligibility for income support, but they do for legal aid. But if its not his house..........
