Hi all, I want to introduce myself. I am 48 with no children. On Jan 1 2015, I asked my husband for a divorce after 19 years of marriage. I asked him to move out of the house and he wouldn''t respond so I moved into the spare bedroom. After repeated attempts to get him to "work" through a Separation Agreement, in which he wouldn''t even discuss, I knew it was going to miserable. We met in 1994 and I really thought that "he" was the one. Neither of us were ever married. We were both in our late 20''s when we married and we both discussed that we were ready to move on to bigger and better things at our age. We have no children. As I was starting my new career in Real Estate in 1998, he was separating from the Navy after 5 yrs of service. My career took off immediately and I am still successfully selling RE. Meanwhile, he has gone through CDL licensing, RE licensing, Taxi cab driver, and most recent job for the last 5 years was a pizza store manager, until he quit his job last Sept and now does nothing but collect unemployment. and most times just not working. l was granted an uncontested divorce last week in Virginia. My ex-husband was not at the hearing because he didn''t know about it. We had him physically served divorce papers in January and after the 21 days to respond, he didn''t nor any attorney. So after 21 days we filed again for a hearing date. That happened last week and the judge granted divorce on the knowledge that he was physically served. The divorce decree provides for a reserve right to argue property distribution after the divorce. My question is after the required 30 day "appeal" time, can I kick my ex-husband out of the home? The home is in my name only though purchased during marriage with my own down payment. I understand that we will still need to argue for equitable distribution later but can I get him to leave the house after the 30 days is up? Thank you in advance
