On 18th Sep 2019 the Aldershot and Farnham UK Court granted interim spousal maintenance to my x-wife at a rate of £750 per month starting 1st Oct and to continue until the former marital home was sold at which point she would receive 55% of the equity (approx £230k). The former marital home is sold and we expect to complete the sale early February. My question is do I have to pay her the February spousal maintenance? The court order does not state when in the month the payment should be made, just that it's at a rate of £750 per month. All previous payments I have made have however been at the start of the month ie 1st Oct, 1st Nov, 1st Dec and 1st Jan. Thanks

There are a couple of things.

Firstly, the house isn't sold until completion and monies have been exchanged. From that point of view I would say that you have to make the maintenance payments until then.

Secondly, are the maintenance payments made in advance or arrears? If the latter, you might still have to make a payment, or part of a payment, after completion on the property.
