Starting to mess around with arrangements

I have just filed for divorce after 2 years separation and up until this point we equally looked after my daughter and my ex has just about stuck to what we have informally agreed.

He is now starting to mess around, he is not signing the divorce papers which is another matter and I am looking to serve a Petition. But he has now 3 times in as many months just turned around and said he can not look after our daughter for the next X amount of days, without notice or good reason.

We have an informal parental plan drawn up and signed but I am pretty sure this acts as nothing but as an agreement for us. My question is therefore what do I need to do to try and get more control over this situation? can I get more control and is it a separate process to the divorce?

Has anything changed recently? work patterns, a new partner, health issues, new social activities etc? Often, when arrangements have been working well for a long period of time, and then there are difficulties, it usually due to a change of some sort.

The parenting plan is not legally binding or enforceable, it''s a written agreement about the child arrangements. Trying to resolve the situation isn''t about one parent gaining "more control" than the other, but about trying to find the root cause of why he has been unable to have your daughter (there may be a perfectly reasonable and genuine explanation) and working together to resolve matters - a family mediator will be able to help you with this.

As I''ve explained before, the divorce only deals with the legal dissolution of the marriage, and doesn''t deal with resolving financial matters or child arrangements.
