father wants to change surname ??

ex wasnt around in pregnancy, birth etc. He refused to reply to communications around the time i registered our baby and so i registered him on my own. He has my surname (mother btw). We are going through court for a child arrangements order and i recieved paperwork that he wants to change babys surname to his ??

whats the chances the judge will allow this?
bear in mind im an only child and baby is my only son, my dad died and i want to carry his name on . I wont have any other children( have 4) and he only has this child so may have more? Ex has a criminal record for violence on a police constable and has admitted to CAFCASS he is a drug user !!

baby is only 7 months and im bf , he sees him in a contact center fortnightly which im happy with but he wants baby more often. My other children dont want him near our home (throws things at me even when holding 7 day old baby ! and calls me names and trys to include my older children in arguments they are 10 and 14 ) and i have a court undertaking ( he was stalking me, driving up and down my street etc)to say he wont contact me or come near my home .

Im so worried how this is all going to end up :( i dont trust him and since he signed undertaking i feel he is doing all he can to keep hold of any control over me that he can !

Has the court ever changed a childs name even when father refused to come to registering of child?
please someone help :(

They won''t change the name without your consent. This is an unreasonable request given that he did not attend to register the birth and I take it you are unmarried? It''s normal for child to take your surname if that is the case, unless mum is happy for child to take unmarried partners surname to start with.

Please don''t worry, just sit tight and let him ruin it for himself.

He has put in for a specific steps order , his reasons for wanting name change is - " traceability and biological link " .. Surely that goes both ways though and isn''t good enough reason ? Why does a father have more right then a mother to give a child their surname ? I''m really worried what will happen . Id have so much paperwork to change too if he gets his own way . I know he just wants to feel like he has some control over something as nothing has gone his way yet !

Hi Aliceinwonderland02, try not to get yourself too upset by this, I think it is extremely unlikely a court would accede to this application.

There are two hurdles the father would have to overcome. The first is that he would need to prove that changing the child''s surname to his would enhance your son''s welfare. The second is to show that the original registration of the birth was in error in some way. I can''t see that he has a hope in hell of proving either point.

The father''s involvement and behaviour hitherto will also carry weight with the court.
