My husband and I are getting divorced. We are both 36 and we have a theee year old who lives with me. He hardly ever sees her. I have approx £120k in private pensions and he has never paid into a pension so has £0. He is a pilot who has always worked on contract and has just started a new job 6% employee contribution, 15% employee contribution.

I now work for a charity and I'm not paying into the pension at the moment because I can't afford to.

We are about to start mediation but ultimately I think we will end up in litigation as our property issues are incredibly complicated (third party interest).

What would you advise I go for with regards to pension in the mediation? Can we exclude it as we are so young? Will he try and go for 50% of my pension? Can I lay claim to any of his future pension rights?

Will there be a pension sharing order if court is involved, probably not, your too young, will your pension value be accounted yes it will.

What you need is some form of report from a lawyer that takes into account all of your circumstances, and it will be all, only then can you conclude an agreement, mediation is a great idea only if you have some idea of entitlement from the get go.
