I am in throws of completing form E. Could any one help with regard to Part 4.

I feel a bit of a foolish to have to ask this question . It asks for the name and address of pension arrangement. Is this:

The name of the company that you worked for or the name of the company that administer the pension on there behalf.

Also Part 6 . I have one pension in payment , I therefore receive a payslip each month and a P60 at the end of the year . How would I deal with this in part 6 as pensions payments is also in section 10.

Any advice would be grateful

I put both. The name of the company, then in the address I put the name and address of the administrators.

A pension in payment should also be valued, however if it's a defined benefits scheme the cost of obtaining the valuation might be quite high as there is no obligation for the administrators to provide a free CETV.

If it's a small pension you might try to dodge the issue by saying the value is not known, and see if the judge at first appointment orders a valuation to be obtained. In the meantime you can ask the administrators how much the valuation will cost.

Thanks Luna, I have two Pension both of which are of small value.
I do have CETV for both that I received when we had gone to mediation in 2015. I have requested new figures but they have not arrived. I am also concerned that I may have to end up to paying a fee for the pension in payment as it states on the old paperwork that the one is free and any subsequent would be charged for.
I was going to put the value as at the date I got them in 2015 on the Form E and then also enclose the paper work along with the request for new figures.
Does any one know whether this would be acceptable.

I am still confused with section 6 with regard to Payslips on P60 as I receive both of these from pension in payment, but the this is also dealt with in section 10.

Which section should be accountant fall as it cant go in two section.

Can anyone Help!!

Sorry I couldn't answer that bit before - I needed to be on my laptop so I could check the format of Form £.

Section 6 is for income from employment only. This means current job, not a pension you receive from a former employer.

Therefore your pension income goes into Section 10 only.

And yes, enclose the old value and paperwork, the request for a new valuation, and if you know what the fee is for a valuation state that too. The judge at first appointment will make a decision on whether it is proportionate to get a new valuation or not.

It would have cost my ex £1200 for a valuation on his pension in payment, in the end we agreed a value between us for it so that was money that didn't have to be spent. Although this is incorrect according to the practice directions (which insist that a valuation be carried out regardless) the individual judge can use common sense.
