hi i have been split from my husband since Dec 2012 I left due to emotional, financial and previous domestic violence.
i left with nothing having been made to return my car as v5 was in his name. i took nothing but clothes from the rented housing association house as he wouldn't let me take anything.
divorce nisi has gone through started in august 2017. absolute not yet applied for.
as a nurse in the nhs i have 2 pensions 1998 (worth £90,000) and 2015 (worth 16,000)
my husband doesn't have a pension and is a company director.
i agreed begrudgingly to his getting 35% of my 1998 pension as he wouldn't take anything less and i cannot afford the costs of fighting.
the judge knocked back the Consent Order stating the transferor and the transferee were the wrong way round (which they aren't). it has now been referred to the courts 09/07/2018.
my question is why??
my husband has pleaded poverty stating no assets and i have just found out that he has bought a house for £130000. I'm not bothered about anything from him i just want my pension.
i cannot afford for this to drag on. i unlike him do not have the money.
please advise I'm desperate.

Sorry you have had to wait for a response.

How long were you married? Are there children to consider?

When you say it has been referred to the courts, do you mean you have been asked to attend a hearing?

The judge will need to be satisfied that the financial disclosure is appropriate - i.e. that the true financial picture has been disclosed - so they can see whether the agreement you have reached is fair. Even if they think it isn't fair, you would be given the opportunity to explain.

Have you had legal advice? Have you seen full details of your ex's income and company accounts?

Attended court today and it has been adjourned. The financial pension annex has been submitted incorrectly by divorce online. The copy that I have is correct and they copy the court has was incorrect. I did however bring up that I was having second thoughts regarding his disclosures. So therefore adjourned. My ex was very angry regarding this and appeared to make verbal veiled threats upon leaving court. For the form E full disclosure can I do myself or do I have to apply to the courts???
