Hi all,

It has been 7 years or more since my last post and 7 years since my divorce.

As part of that 2011 divorce settlement my then wife was given 70% of my primary pension pot (I had a few others, the net effect was we got 50% each). pension sharing Order, not earmarking.

That pension is really not performing and I want to move it elsewhere. And thats where I have an issue. My wife moved in with her boyfriend and neither of them really work, she has no real interest in the pension, has never acted on the transfer, and won't discuss it with me. Now that I am trying to transfer my share of the pension out the pension company are refusing to act upon it, saying that she still has a share and that she has been ignoring their letters for years.

What options do I have? Can I compel the pension company to transfer my 30% out? Or am I forever tied to a poorly performing pension because my wife apparently doesn't need £50k?

James

Am going through a pension sharing order now, and my wife has a final salary pension , so i can understand it being difficult. You may need to speak to a solicitor and they offer good advice on this site. best wishes
