My ex pushed hard for and got a 50% share of both the marital home and my pension via a PSO on condition that home sold before September 2016. House has still not sold ( April 2019), she does not want to accept price offered but I do. What routes are open to me?

I. Can I enforce a sale?
2. Can we reverse or vary pension sharing order so she can buy me out?

Since the divorce I have lost my job and not found new work, she has now found work but cannot raise the mortgage/ funds to buy me out without using pension fund.

Hi,

Yes you can apply to the courts for enforcement. The court will set a sale price and give you conduct of sale.

Has the pension share been implemented? How old is she? Is she able to realise cash from the pension fund under the new pensions legislation?

Thanks Hadenoughnow,

I'm an infrequent visitor so have just seen, but yes she can start to claim her pension and withdraw a Lump sum if she wishes.
