I have just got my CETV
Can someone tell me what my husband could be entitled to and I’m petrified!! He’s had the affair and yet if my understanding is right he could be entitled to half?

Letter says CETV payable of my behalf would be £142,677 does that mean I need to find £70k to pay him off?
He’s 52 I’m 38, he doesn’t have a pension but owns a number of rentals (can I presume that they may offset my pension?)

Help

Financial settlement on divorce is about needs first. There a lots of factors that are considered, including pension.

Depending on the length of the marriage, the start point for division is 50:50. Any departure from equality would have to have a good reason for it.
This may be e.g. because one of the parties earns less and needs more equity to rehouse.

All of the assets go into the pot. This would include rental properties in his name.

Are you represented? If you don't have a solicitor and you need support, it may be worth calling the helpline to see what assistance we can offer.

I have appointed a solicitor as although I know it will cost me some money I think it will help protect me, I would love to have completed it amicably but I dont trust him to do the right thing. My earnings/pension are very transparent due to the nature of the job- his however not so much.

He hasnt responded to anything my solicitor has sent, the divorce papers have arrived and hes not even looked at them- I think thats because its not on his terms and I have been "proactive" So unfortunately and ultimately it could end up in court
