Hi

My husband is not disclosing his pension (which I'm afraid I know nothing about, other than that he has one). He's saying he 'wants to keep things simple'. I've practically had a breakdown over this, which I think he's taking advantage of, but I don't know if I'm strong enough to fight him in court. (married 10 yrs, no kids, his salary 90k, mine 9. PH., though I'm not working anymore due to this..) Any ideas/ thoughts greatfully received :.

pension sharing has been enshrined in law for years now.

Even if you end up offsetting any potential share against cash in order to meet your housing needs, you still need to know the size of his pension. NB pension accrued prior to the relationship may be excluded. Did you cohabit before marriage? Cohabitation that runs seamlessly into marriage all counts towards the length of the marriage.

Pension sharing is just part of the equation. Other assets including property, savings etc are taken into account as are your respective needs. If there are no children to consider your strict need would be a 1-2 bed property.

How old are you both? What assets, including former matrimonial home, do you have in sole and joint names?

You cannot and certainly should not reach any agreement on financial settlement without full financial disclosure.

If he won't disclose, you will need to apply to the court so he has no choice. The court process is about settlement; once the finances have been disclosed you will be encouraged to reach settlement. The judge will advise. Only a very few cases end up at a contested final hearing.
