Good morning

I am helping support my friend during and after his divorce; he has received his cash share of the former marital home, but the pension share order is proving very difficult. It is now over one year since his Decree Absolute triggered the 4 months that the pension trustees should be working to in order to share the pension as per the court order. Nothing is happening, and I mean nothing. Communication from my friend to the ex's pension trustees remains unanswered. So, back in January this year he asked for help from the Pension Ombudsman; the case was accepted, however they are so inundated with work that even allocating a caseworker is going to take a further 9 months. That means a further year with this unacceptable situation. Is there really no other way to get the parties concerned to do their job? can we actually have recourse through the courts? any help appreciated. Thank you.

Is the problem with the pension fund or your friend's ex? Has the paperwork been submitted to the trustees/pension provider? Are there fees to be paid ?

If there is a failure on your friend's ex's part, this is a breach of the order which can be enforced on application to the court.

Thank you for your response. My friends ex has a history of delaying tactics - it is really impossible to ascertain who is either waiting for information or what information they actually have; hence the Ombudsman route. My friend has submitted all the information he has been asked for from his ex's pension fund - but that is where it ends. It does seem very unfair to be stuck in limbo like this. I guess we shall just have to wait. Thank you for your time.
